Indemnity Form for Visiting Pilots — Fly Inn Estate Private Airfield

This indemnity agreement is made between Fly Inn Estate ("the Airfield Operator") and the undersigned visiting pilot ("the Pilot"). The Airfield Operator manages a private airfield at Fly Inn Estate, Gauteng, South Africa, with one runway (6/24), for aviation activities. The Pilot wishes to use the Airfield Operator's facilities — including the runway, taxiways, hangars, and associated areas — and acknowledges the inherent risks of aviation activities and the requirement to comply with all applicable South African aviation laws, including those enforced by the South African Civil Aviation Authority (SACAA) under the Civil Aviation Act, 2009, and related regulations.

1. Acknowledgment of Risks

The Pilot acknowledges that operating aircraft and using the Airfield Operator's facilities involve inherent risks, including collision with other aircraft, vehicles, or objects; damage to aircraft or property due to runway conditions, weather, or other factors; personal injury or death resulting from aviation activities; and risks associated with operating in uncontrolled airspace or at a private airfield without published METAR data.

2. Indemnity and Release

The Pilot indemnifies, holds harmless, and releases the Airfield Operator, its owners, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of or in connection with the Pilot's use of the Airfield Operator's facilities, whether caused by the Pilot's negligence, actions, or omissions, or those of any third party — including damage to the Pilot's or the Airfield Operator's property, personal injury or death to the Pilot or any third party, and any breach of South African aviation regulations or laws by the Pilot.

3. Compliance with Laws and Regulations

The Pilot warrants that they hold a valid pilot's licence and any other certifications required by the SACAA, and agrees to comply with the Civil Aviation Act, 2009 and its regulations — including restrictions on flying within 10 km of an aerodrome or in controlled, restricted, or prohibited airspace without SACAA approval, and restrictions on flying over private property without permission. The Pilot confirms their aircraft holds a valid certificate of airworthiness as required.

4. Insurance

The Pilot warrants that they maintain adequate aviation insurance, including liability coverage for damage to third parties or property, and agrees to provide proof of such insurance to the Airfield Operator upon request. The Airfield Operator is not responsible for providing insurance coverage for the Pilot's aircraft, activities, or liabilities.

5. Conditions of Use

The Pilot agrees to use the airfield only with prior permission from the Airfield Operator or a designated resident host, to adhere to all airfield rules — including maintaining safe distances from persons, property, or restricted areas per SACAA regulations, and operating only within the Pilot's licensed capabilities and aircraft limitations — and to conduct no commercial operations unless expressly authorised by the Airfield Operator and compliant with SACAA regulations.

6. Liability for Damage

The Pilot is solely responsible for any damage caused to the Airfield Operator's property or facilities resulting from the Pilot's actions or omissions. In accordance with Section 8 of the Civil Aviation Act, 2009, the registered owner of an aircraft is deemed liable for damages caused by the aircraft in certain circumstances; the Pilot confirms they are either the registered owner or have authority to operate the aircraft.

7. Governing Law

This indemnity agreement is governed by the laws of the Republic of South Africa. Any disputes are subject to the exclusive jurisdiction of the courts of South Africa.

8. Acknowledgment

By signing below, the Pilot acknowledges that they have read, understood, and voluntarily agree to these terms, and have had the opportunity to seek independent legal advice before signing.
